Ministry of Home Affairs Amends Transaction of Business Rules for Jammu and Kashmir

New Delhi, 12th July 2024 — The Ministry of Home Affairs has issued a notification regarding amendments to the Transaction of Business of the Government of Union Territory of Jammu and Kashmir Rules, 2019. This amendment, effective upon publication in the Official Gazette, introduces several changes aimed at streamlining governance and decision-making processes.

Key Amendments:

  1. Rule 5 Amendment:
  • A new sub-rule (2A) has been inserted, which stipulates that any proposal requiring the previous concurrence of the Finance Department concerning ‘Police’, ‘Public Order’, ‘All India Service’, and ‘Anti Corruption Bureau’ will be considered or rejected only after being placed before the Lieutenant Governor through the Chief Secretary.
  1. Rule 42 Amendment:
  • Two new sub-rules (42A and 42B) have been added:
    • 42A: The Department of Law, Justice, and Parliamentary Affairs must submit proposals for the appointment of the Advocate-General and other Law Officers to the Lieutenant Governor through the Chief Secretary and the Chief Minister.
    • 42B: Proposals regarding the grant or refusal of prosecution sanctions or the filing of appeals must be submitted to the Lieutenant Governor through the Chief Secretary by the Department of Law, Justice, and Parliamentary Affairs.
  1. Rule 43 Amendment:
  • After the third proviso, new provisos have been added:
    • Matters connected with Prisons, Directorate of Prosecution, and Forensic Science Laboratory must be submitted to the Lieutenant Governor by the Administrative Secretary, Home Department, through the Chief Secretary.
    • Proposals related to the posting and transfer of Administrative Secretaries and cadre posts of All India Services officers must be submitted to the Lieutenant Governor by the Administrative Secretary, General Administration Department, through the Chief Secretary.
